Terms Of Service

1) Agreement to these terms

These Terms of Service ("Terms") apply when you download, access, or use FocusKit, including the FocusKit app, website, widgets, Apple Watch features, and related services (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

3) What FocusKit does

FocusKit is a productivity and focus tool designed to help you plan focus sessions, take breaks, follow routines, view momentum, and access related timer or insight features across supported devices.

FocusKit is not medical, mental-health, legal, financial, or other professional advice. You remain responsible for deciding whether the Service is suitable for your needs, schedule, health, and work environment.

4) License to use FocusKit

Subject to these Terms and any applicable app marketplace rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use FocusKit on devices that you own or control and as permitted by the applicable marketplace terms.

FocusKit is licensed, not sold. We and our licensors keep all rights, title, and interest in the Service, including software, design, text, images, branding, and other content, except for rights expressly granted to you in these Terms.

5) Acceptable use

You agree to use FocusKit lawfully and respectfully. In particular, you must not:

  • copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service except where applicable law allows this despite the restriction;
  • interfere with, disrupt, overload, or compromise the Service or any systems used to provide it;
  • use the Service to violate the rights of others or any applicable law, regulation, or marketplace rule;
  • share access to paid features in a way that bypasses marketplace or subscription controls.

6) Subscriptions and in-app purchases

FocusKit may offer paid features, subscriptions, trials, or other in-app purchases. The price, billing period, renewal terms, trial availability, and included features are shown before purchase in the applicable app marketplace or purchase screen.

6.1) Marketplace billing

Purchases are processed by the applicable app marketplace, such as Apple's App Store, under that marketplace's payment and account terms. The marketplace may charge your selected payment method, handle taxes where applicable, and manage renewals, cancellations, and refunds.

6.2) RevenueCat

We may use RevenueCat to help manage purchase status, subscriptions, entitlements, and related billing information. RevenueCat supports our subscription infrastructure, but it is not presented here as the direct merchant for your purchase.

6.3) Cancellation and refunds

You can manage or cancel subscriptions through the marketplace account settings used for the purchase. Unless the marketplace terms or applicable law say otherwise, paid subscriptions renew automatically until cancelled, and cancelling prevents future renewals rather than automatically refunding past charges.

Refund requests are handled according to the applicable marketplace rules. For Apple purchases, you can use Apple's refund process or contact Apple Support.

7) Availability, changes, and support

We aim to keep FocusKit useful and reliable, but we do not promise that the Service will always be available, error-free, or compatible with every device, operating system version, widget, watch face, or third-party service.

We may update, improve, suspend, or discontinue parts of the Service where reasonably necessary, for example to maintain security, comply with law, adjust to platform changes, or improve the product. We will try to avoid unnecessary disruption to paid features.

8) Intellectual property

FocusKit, including its name, icon, interface, design, software, graphics, text, and other materials, is protected by copyright, trademark, and other laws. You may not use FocusKit branding or materials in a way that suggests endorsement, partnership, or ownership unless we have given written permission.

9) Disclaimers

FocusKit is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of fitness for a particular purpose, uninterrupted operation, and non-infringement.

No productivity app can guarantee a particular result. Focus sessions, insights, streaks, routines, reminders, and similar features are tools for your own planning and reflection, not guarantees of performance, health, income, or outcomes.

10) Liability

Nothing in these Terms limits liability where it cannot legally be limited, including liability for intent, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer protection rights.

For slight negligence, we are liable only for breaches of essential contractual obligations and only for foreseeable, typical damages. Essential contractual obligations are obligations whose performance makes proper use of the Service possible and on which you may regularly rely.

11) Termination

You may stop using FocusKit at any time. You can delete the app from your devices, but deleting the app may not cancel an active subscription. To stop future subscription renewals, cancel through the applicable marketplace account settings.

We may suspend or terminate access to the Service if you materially breach these Terms, misuse the Service, create legal risk, or if we are required to do so by law or platform rules.

12) Consumer rights and governing law

These Terms are governed by the laws of Germany, excluding conflict of law rules. If you are a consumer living outside Germany, you may also have mandatory rights under the laws of your country of residence. These Terms do not limit those mandatory rights.

If any part of these Terms is invalid or unenforceable, the remaining parts continue to apply.

13) Updates to these terms

We may update these Terms from time to time, for example when we add features, change paid offerings, adapt to platform requirements, or need to reflect legal changes. The updated version will be posted on this page with a new date.

If a change materially affects your rights or obligations, we will take reasonable steps to notify you where required. Continued use of FocusKit after updated Terms take effect means you accept the updated Terms.
